The rental agreement

Terms & Conditions

The terms that apply to renting portable restrooms and hand-wash stations from us, and to using this website.

Riverside Porta Potty rental units

Who these terms are between

These terms cover the rental of portable restrooms, accessible units, hand-wash stations and restroom trailers from Riverside Porta Potty, and the use of this website. "We" and "us" mean Riverside Porta Potty; "you" means the person or business hiring the equipment.

Nothing on this website is an offer or a contract. Rentals are agreed on the phone, and the terms of the individual rental - the units, the dates, the delivery address and the price - are whatever we confirm with you on that call.

Quotes and prices

Prices are quoted on the telephone against the specific job: the unit type, how long you keep it, the delivery address and the service frequency. A quoted price includes delivery, the agreed servicing, chemical and consumables, and collection at the end.

A quote holds for a reasonable period and against the details you gave us. If the job changes - a different address, more units, a longer term, a service frequency that has to increase - the price changes with it, and we will tell you before we act on it.

Delivery, placement and access

You are responsible for telling us where the equipment goes and for making sure the route and the placement point are safe, level, firm and clear for a delivery vehicle. We will not force a delivery into a space we judge unsafe, and if a site turns out to be unreachable on the day, an aborted delivery may be chargeable.

You are also responsible for any permission the placement needs - a landlord, an HOA, a venue, or a city permit for a unit standing on public ground.

Servicing

Servicing happens on the schedule agreed at booking - as standard, once a week. A service visit covers pumping the waste tank, fresh chemical, restocking paper and consumables, and wiping the touch points.

Our staff must be able to reach the unit on the service day. If access is blocked - a locked gate, a vehicle parked in, a unit moved without telling us - the visit may be missed and still chargeable.

Your responsibilities while you have the equipment

Keep the unit where it was placed. Do not move, relocate or lift it yourself - call us and we will move it, normally on a service run. Do not put anything in it other than ordinary restroom waste and paper: no chemicals, no solvents, no trash, no construction debris.

The equipment stays ours throughout the rental. You are responsible for it while it is on your site, including loss, theft, vandalism and damage beyond ordinary wear.

Damage and additional charges

Ordinary wear is ours. Damage caused by misuse, overturning, fire, vandalism or contamination with prohibited waste is charged at the cost of repair or replacement, and we will tell you what it is before we invoice it.

Additional pump-outs beyond the agreed schedule, missed-access visits and aborted deliveries are chargeable at our normal rates.

Payment

Payment terms are agreed at booking. The due date printed on each invoice is the date payment is expected by. We may suspend servicing or collect the equipment on unpaid accounts, and reasonable recovery costs may be added to overdue balances.

Changing or canceling a rental

Call us. Changes made with reasonable notice are usually free of charge. A cancellation made after the equipment has been loaded or delivered may attract a charge covering the work already done.

Collection happens after you call to end the rental. Rental charges run until the equipment is available for collection.

Liability

We are liable for loss or damage caused by our own negligence or breach of these terms. We are not liable for indirect or consequential loss - lost profit, lost business, delay to a project or an event - and our total liability for any rental is limited to the charges paid for that rental.

Nothing here limits liability for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

Circumstances outside our control

We are not in breach of these terms for a delay or failure caused by something outside our reasonable control - severe weather, wildfire, flood, road closure, civil emergency, utility failure or an act of a public authority. Inland Empire conditions being what they are, this clause is not theoretical.
